Senator Brophy, prime sponsor, commented on the bill, explaining that the bill relates to a requirement that the registered agent of a small donor committee certify that contributions received in the form of membership dues transferred by membership organizations are from permissible sources. Senator Groff said that he does not believe that the bill fits under the Governor's Call for the special session. The committee discussed whether or not the bill fits under the Call.

Senator Teck, prime sponsor, described the bill which would memorialize Congress to adopt legislation to deny citizenship at birth to children born in the U.S. to parents who are not legally present in the US. Committee discussion ensued.

Adrienne Benavidez, Coloradans of Color, testified against the memorial. She described the case of an immigrant who left the U.S. and was denied reentry. This resulted in a U.S. Supreme Court decision on this subject.

Senator Jones, prime sponsor, described the bill concerning enforcement of immigration laws by law enforcement agencies in Colorado.

11:17 AM -- Sam Mamet, Colorado Municipal League, said that he is concerned about how the bill would be implemented by local governments.

Sheriff Grayson Robinson, Colorado County Sheriffs, opposed the bill. He said that he does not believe that there is adequate funding or jail space to implement the bill. He also expressed concern about the impact of the bill on homeland security funding. He said that ICE in the Denver region has only 300 beds available. He described a process by which the jails are reimbursed for the cost of housing these inmates. He commented on crimes committed by illegal immigrants.

Adrienne Benavidez, Color of Justice, opposed the bill. She said that the bill would result in significant costs to counties. She said that local law enforcement agents are not supposed to be out enforcing immigration laws, that the bill would reduce trust between police and immigrant communities, and increase their risk of civil liability.

11:44 AM -- Sheriff Grayson Robinson, Colorado County Sheriffs, commented on procedures by which police currently detain and process illegal immigrants. He said that he is not confident that they currently have this authority.

Sam Mamet, Colorado Municipal League, opposed the bill, and said that it is uncertain how the bill would be implemented at the local level. Senator Kester said that he believes that the bill will be cost neutral to local governments. Mr. Mamet said that he would like to have precise language in any bills affecting to local governments.

Senator Wiens commented on the recent ruling of the Supreme Court and said that this measure and SCR 1 respond to the ruling, and "allow the people to have their say on the matter." He said that the public has been deprived of their right to vote on the question.

Senator Evans, prime sponsor, described the resolution, which would refer to the people a constitutional amendment concerning the restriction of nonemergency governmental services to those who are lawfully present in the U.S.

12:55 PM -- Mark Baisley, Littleton, said that he has owned a business in Colorado since 1992. He said that immigration laws should be enforced at the federal level, but that laws should be enacted at the state level to the extent possible. He stated his support for the bill and said that technology is allowing businesses to hire less skilled workers.

Laurel Herndon, Boulder, Immigrant Legal Center of Boulder County, said that there is crisis in immigration, but that it should be addressed at the federal level. She said that businesses must hire persons who present documents that are facially valid, or be subject to civil lawsuits.
