Representative Harvey presented an overview of House Concurrent Resolution 06S-1001, concerning the constitutional restriction of public benefits to persons who are lawfully present in the United States, with the exception of certain services. Representative Harvey discussed the recent Colorado Supreme Court decision that disallowed the inclusion of a citizen initiative on the November ballot addressing public services for illegal immigrants.

Representative Harvey reacquainted the committee with House Concurrent Resolution 06S-1001. Representative Harvey discussed the political considerations of the special session, and the relationship between the concurrent resolution and the initiative rejected by the Supreme Court. Discussion followed regarding the impact of the special session on immigration reform issues. Committee members also aired opinions and grievances over the way the process was conducted during the special session, and discussed the impact of enacting immigration reform measures through the state constitution, rather than through statute. No amendments were offered for House Concurrent Resolution 06S-1001.
