Representative M. Carroll, prime sponsor, presented House Bill 06S-1001. The bill specifies that an employer must provide proof to the Colorado Economic Development Commission that all of its employees are United States citizens, or lawfully present in the state, and authorized to work in order to be eligible for economic development incentives. If the commission determines that an employer who received an incentive is not in compliance with federal immigration employment law, the employer must repay the incentive within 30-days and is ineligible to receive incentives for 5 years. Additionally, local governments are encouraged to ensure that all employers who are awarded economic development incentives employ only citizens or those lawfully present in the state who have the authority to work. The bill applies to incentives awarded by the commission on and after October 1, 2006.

Glen Colten, representing the Northern Coloradoans for Immigration Reduction, talked about his opposition to immigration. He stated that illegal immigration is a threat to America's security. Mr. Colten said the state should require employers to verify the status of their employees and deny benefits that are not required by the federal government to illegal aliens.

Wanda Weatherford, representing herself, testified against illegal immigration and for legal immigration. She stated she feels that illegal immigrants are taking jobs from lawful citizens and causing citizens to be unemployed and underemployed.

Terri McNabb, representing the Colorado Minutemen Project, testified in support of the bill. She asked that the state use the Systematic Alien Verification for Entitlements (SAVE) program. She explained that SAVE is a federal program that allows employers to verify documents of all future hires. Ms. McNabb distributed a handout to the committee about the program (Attachment A).

Trudy Haines, representing herself, testified in support of the bill. She stated that the number one way to stop illegal immigration is to sanction and prosecute employers.

Representative M. Carroll responded to questions from the committee about existing federal law.

Pete Roskop, representing the Office of Economic Development and International Trade, was asked to comment on what is currently required from employers who apply for incentives. He stated that in the contract for incentives, the office states that the employer cannot hire illegal aliens. Representative M. Carroll explained that the bill is requiring proof that employers are following the requirement in the contract. Mr. Roskop explained Amendment L.001 that makes a technical change that clarifies that the bill applies to employees hired with in the United States so it does not hurt international businesses.
