Representative King, prime sponsor, presented an overview of House Bill 06S-1006, concerning the abrogation of common law marriage. Representative King explained the history of common law marriage and the recognition of common law marriage in Colorado and other states. Representative King then discussed whether the bill fit within the guidelines of the Governor's call for a special legislative session. Discussion followed regarding the number of common law marriages in Colorado and how a common law marriage is established.

Discussion ensued regarding the effect of negating a common law marriage by a court of law, and the effect of such negation on affected children. Representative King responded to questions regarding his decision to eliminate common law marriage in the bill, as opposed to setting a minimum age for common law marriage.
