01:37 PM -- Senate Bill 06-212

Senator Hagedorn introduced Senate Bill 06-212. The bill allows a dental hygiene proprietor to employ or contract with a licensed dentist to provide dental services when necessary. He distributed amendment L.002 (Attachment A) to the committee. The amendment strikes the language authorizing a dental hygienist to employ or contract with a dentist and substitutes language specifying that a dental hygienist and a dentist may enter into an agreement for the lease or rental of equipment or office space in the same physical space. The agreement is conditional on the requirement that the determination of necessary dental services and the professional responsibility for those services remain with the dentist.

Patricia Armbroste and Claire Silk, representing the Colorado Dental Hygienists Association, and Shelby Kahl, representing herself, testified in support of the bill. Ms. Kahl testified regarding her concerns with amendment L.002, stating that the portion of the amendment that states that it is the responsibility of the dental hygienist to inform the patient as to whether there is a supervisory relationship between the dentist and the dental hygienist does not benefit dental hygienists or the public. She asked that the language be removed from the amendment. Ms. Kahl responded to questions from Senator Johnson regarding how the bill, as amended, changes current practice. She further responded to questions from Senator Shaffer regarding her objections to amendment L.002.

Dr. Jeff Hurst, Dr. Rhett Murray, and Dr. John Hanck, Colorado Dental Association, testified in support of the bill as amended. Dr. Hanck stated that the amendment resolves the Dental Association's concerns with the original bill and responded to questions from Senator Johnson regarding the portion of the amendment specifying that it is the responsibility of the dental hygienist to inform the patient as to whether there is a supervisory relationship between the dentist and dental hygienist. Dr. Hearst, Dr. Murray, and Dr. Hank responded to questions from Senator Shaffer regarding whether the amendment's language mandated a dental hygienist to inform patients regarding the relationship between the dentist and the hygienist.
