Senator Takis, Chair, called the meeting to order.

10:09 AM -- House Bill 06-1162

Senator Williams, prime sponsor, explained the provisions of House Bill 06-1162, concerning restrictions of minor drivers under eighteen years of age. HB 06-1162 increases the age of minor drivers that are subject to specific from under 17 years of age to under 18 years of age. It enhances the penalty for minor drivers under 18 years of age who violate the traffic laws concerning the use of restraining devices and seatbelts in motor vehicles. Senator Williams distributed prepared amendment L.003 (Attachment A). Senator Williams answered questions from committee members. She reviewed 2005 legislation concerning minor driver restrictions.

Lynnette Dilbeck, representing the American Automobile Association (AAA) of Colorado, testified in support of the bill. She stated that HB 06-1162 provides safety for teen drivers.

10:22 AM --
Savannah Clay, representing herself, testified in support of the bill. She stated that many of her friends do not wear seatbelt and HB 06-1162 will encourage them to do so. Ms. Clay answered questions from committee members and stated that she received driver training at her school.

Terry Campbell, representing the Colorado State Patrol, testified in support of the bill. He answered questions from committee members and stated that the community service is monitored by the courts.

Senator Williams further explained the provisions of HB 06-1162 concerning the enhanced penalties for minor drivers under the age of 18 years who violate the traffic laws concerning the use of restraining devices and seatbelts in motor vehicles. Committee discussion ensued regarding such penalties.

Terry Campbell explained prepared amendment L.003 (Attachment A). He explained that the amendment makes the penalties consistent with House Bill 06-1125, concerning motor vehicle restraining devices. Mr. Campbell answered questions from committee members and stated that the judge decides what the community services will be.

Senator Wiens explained that the language of HB 06-1162 is consistent with 2005 legislation concerning minor drivers restrictions.

She stated that the amendment is consistent with the amended version of HB 06-1125, concerning motor vehicle restraining devices. Senator Spence expressed concern with amending the bill even though HB 06-1125 has not been passed.
