01:04 PM -- Conference Committee on House Bill 06-1251

Representative Green distributed proposed conference committee report CLHB 1251.004 (Attachment A). She explained that the proposed conference committee report would accede to the Senate version of the bill by changing the provision in the bill that addresses when the price of a good is unreasonable and unconscionable. She stated that CLHB 1251.004 would base it on the seller's profit margin 30 days prior to an emergency rather than immediately prior to the declaration of an emergency. Representative Green stated that she spoke with the industry and was told that 30 days is needed. There was committee discussion about the 30 day provision. Representative Massey explained that the word immediately would be better because the price can fluctuate too much over a 30 day period. Senator Tochtrop agreed and asked that the committee adhere to the Senate version of the bill. Representative Massey added that the word immediately is a reaction to an emergency rather than market fluctuation.

The committee decided that CLHB 1251.003 goes beyond the scope of differences and therefore could not be acted upon because the Senate did not receive permission to go beyond the scope. Representative T. Carroll withdrew CLHB 1251.003.
