Representative McGihon reviewed the provisions of the House Bill 06-1336, concerning the enactment of the "Uniform Athlete Agents Act." She distributed two hand-outs (Attachments A and B) and indicated that it is uniform act drafted by the National Conference of Commissioners on Uniform State Laws. She discussed examples of violations by agents and responded to questions about the provisions in the bill. She stated that the National Collegiate Athletic Association (NCAA) supports the uniform act.

Mike Shea, representing the Office of Secretary of State, testified in opposition to the bill. He indicated that the office believes, on the basis of good public policy, that the bill should go through the sunrise review process. He testified that the type of registration anticipated under the bill may be more appropriately be placed in the Department of Regulatory Agencies. He also discussed the fact that bill places the Secretary of State as an "agent for service of process." Further, he discussed the new electronic program the bill would require.

01:46 PM -- Geoff Hier, representing the Department of Regulatory Agencies, testified in opposition to the bill. He expressed the concerns of his department regarding the bill and provided an overview of a sunrise review process. He said that the criteria used is to establish the minimum level of regulation required to protect the public. He discussed current law regarding athlete-agents.

Representative McGihon discussed the process used by the Commissioners on Uniform State Laws to study an issue in preparation for preparing a uniform act to be considered by a state. She said a uniform act is adapted to fit the statutory framework of a given state.

Tom McGrath, representing the University of Colorado at Boulder, testified in favor of the bill. He explained the impact on the university's student-atheletes and on the athletic department of the institution. He reviewed the potential sanctions for an institution for using an ineligible athlete. He responded to questions about how the University of Colorado provides information and discusses compliance issues with its athletes.
