10:34 AM -- House Bill 06-1120

Senator Tupa, prime sponsor, explained that there was a recent U.S. Supreme Court case which resulted in the introduction of this bill relating to intertstate wine shipment. The bill will bring Colorado law into compliance with the Supreme Court ruling. He said that the bill repeals Colorado's current statute. Colorado has had "reciprocity agreements" with a few dozen states.

10:38 AM -- Michi Hackengerger, Wine and Spirit Wholesalers, supported the bill and commented on the U.S. Supreme Court case. The court ruled that in-state wineries must be treated in an identical fashion to out-of-state wineries. The bill allows Colorado wineries to ship directly to consumers. Customers no longer have to visit the winery to order their wine, also there are no limits on quantity.

Matt Cook, Director, State Liquor Enforcement Division, was present to answer questions about the bill. He commented on the concerns of delivery companies. He said that the companies will not leave wine on doorsteps, a signature is required. The bill also prohibits the resale of the wine.

Doug Caskey, Colorado Wine Board, commented on the working group which developed the bill draft. He said the bill is clean, simple and functional. He said that access to wine by minors by mail has not been a significant problem. He said that he has not heard any opposition to the bill from Colorado wineries.

Emzy Veazy III, Burbank, commented on the U.S. Supreme Court ruling. He suggested that the bill be amended "to deal with California."
