Representative Buescher, prime sponsor, presented House Bill 06-1388. He explained that the bill expands the powers of the Department of Revenue regarding the violation of Motor Vehicle Dealer Laws. It authorizes the Executive Director to set rules to administer actions or proceedings that allege a violation of new, reopened, or relocated motor vehicle dealer, related required notice, and grounds for the refusal of a dealer license. The bill specifies that the Court of Appeals has initial jurisdiction for the review of the Executive Director's actions or orders. The Auto Dealers License Fund will pay for the administration of these actions and proceedings.

Bill Walters, representing the Colorado Automobile Dealers Association, testified in support of the bill. He stated the bill is clean-up of a bill that was passed in 2000. It defines relationships between automobile dealers and manufacturers.

John Shenden, owner of Pro Chrysler, testified in support of the bill. He stated that the bill will ensure that the Executive Director of the Department of Revenue has the clear and discretionary authority to hold administrative hearings for violations of statute by motor vehicle dealers and manufacturers.

Matt Timon, representing various dealerships, testified in support of the bill. He gave some examples of disputes that could be brought before the Executive Director of the Department of Revenue.

Tim Jackson, representing the Colorado Automobile Dealers Association, testified in support of the bill. He responded to questions from the committee pertaining to the cash fund. There was a committee discussion about whether the bill would duplicate the Administrative Procedure Act (APA) and why these cases are not currently being handled through the APA.
