12:15 PM -- House Bill 06-1257

Representative Green, prime sponsor, reviewed the provisions of House Bill 06-1257, concerning noise mitigation along state highways. She discussed background on the bill and responded to questions concerning the appropriations required under the bill. Committee members asked additional questions regarding the moneys that would be transferred from the Waste Tire Recycling Development Cash Fund.

Representative Green responded to additional questions regarding the role of the Colorado Department of Transportation (CDOT) in administrating the measures in the bill.

The following persons testified:

12:24 PM -- Sue McMahon, representing herself, testified on the provisions of the bill and reviewed the priority measures established in the bill. She distributed a hand-out (Attachment A).

12:29 PM --
Herman Stockinger, representing CDOT, testified in support of the bill. He indicated that the department supported the bill because of legislative support for noise mitigation discussions last year. He reviewed the provisions in the bill that were important in the department's support of the bill, including the provision of funding through the Waste Tire Recycling Development Cash Fund. Mr. Stockinger additionally expressed appreciation for the bill's recognition of administrative costs. He responded to questions from committee members regarding current department funding for noise mitigation and described current measures taken to address issues around new construction.

Committee discussion continued on current funding for noise mitigation when new construction takes place. Members commented on the potential responsibility of homeowners.

12:38 PM -- Michael Katz, representing himself, testified in favor of the bill and described the products his company offers.

12:39 PM -- Bob Mero, representing CDOT, responded to prior committee questions concerning CDOT noise policies pertaining to imminent planned development. He spoke to authorization in the bill for a local government match for grants and the requirement that a local government have adopted a noise ordinance in order for grants to go forward.

12:44 PM -- James Day, representing himself, testified on the bill and described the impact of noise at his condominium development at Parker Road, near I-225 and Arapahoe Road. He provided a packet of information to the committee (Attachment B).
