01:41 PM -- House Bill 06-1119

Senator Keller, sponsor, presented House Bill 06-1119 concerning security breaches regarding personal identifying information. The bill requires an individual or a commercial entity that conducts business in Colorado and that owns or licenses computerized data that includes personal information to notify customers who are residents of Colorado of any breach of security of the system following the discovery of a breach in the security of personal information of the Colorado resident whose unencrypted personal information was, or is reasonably believed to have been, acquired by an unauthorized person. She presented prepared amendment L.013 (Attachment A).

Cameron Graham, AARP, spoke in favor of the bill with the adoption of L.013. Mr. Graham discussed the realities of identity theft by relating his personal experience. He stated that this bill deals with notice, which is necessary in order to deal with the problem. Mr. Graham responded to questions from the committee regarding the standard that much be met before notice is required.

Dave Emerick, HSBC, spoke in support of the bill with the adoption of L.013. Mr. Emerick stated that this bill protects consumers in Colorado. Mr. Emerick responded to questions from the committee regarding the intent in drafting the bill and L.013.

Rex Wilmouth, CoPIRG, spoke in favor of the bill as amended. Mr. Wilmouth talked about how all parties have compromised to draft this bill. He discussed the need to stop the crime from occurring, rather than merely respond to it after the fact.

Susan Cox, Kaiser Permanente, took no position on the bill. Ms. Cox raised concerns about the ambiguity of the notice requirement on page 5, lines 12-17 of the bill. Ms. Cox responded to questions about the encryption of data by Kaiser Permanente.
