Senator Takis, prime sponsor, explained the provisions of SB 06-115, concerning the rights of a local government with regard to the construction of a private toll road or toll highway. The bill requires a corporation formed for the purpose of constructing a private toll road to:

In addition, the bill allows local government authorities to levy a charge to be used to fund local government costs for capital facilities that serve the toll road. Senator Takis answered questions from committee members. Senator Takis explained and distributed prepared amendment L.002 (Attachment A).

Senator Takis continued to answer questions from committee members and stated that public private partnerships allow local governments to utilize the tool of eminent domain and the bill requires that local governments be involved in the planning process of toll roads. She also stated that the bill does not address eminent domain.

Senator Tapia, prime sponsor, explained the provisions of SB 06-133, concerning the funding of port of entry weigh stations with General Fund moneys rather than Highway Users Tax Fund moneys. Senator Tapia distributed a bill summary sheet (Attachment B). The bill, recommended by the Joint Budget Committee (JBC), provides funding for the administration, operation, maintenance, and further construction of the Department of Revenue's port of entry weigh stations from the General Fund rather than the Highway Users Tax Fund. Senator Tapia also distributed prepared amendment L.001 (Attachment C) and a memorandum explaining the amendment (Attachment D). Amendment L.001 (Attachment C) provides additional moneys to the State Highway Fund and to road projects.
