Representative Buescher, prime sponsor, provided an overview of and background regarding Senate Bill 06-079, concerning the post-enactment review of the implementation of bills by nonpartisan legislative staff. Representative Buescher responded to questions regarding the potential for limiting the amount of legislation subject to post-enactment review and the fiscal impact of the bill. A discussion ensued regarding certain subjective language in the bill and the ability to measure the results of the effectiveness of legislation. Representative Buescher then discussed the accuracy of reporting costs by state agencies associated with legislation subject to the post-enactment review established by Senate Bill 06-079. The committee next discussed alternatives to the bill.

Representative Ragsdale provided an overview of House Bill 06-1357, concerning a prohibition on the inspection of applications for marriage licenses. Representative Ragsdale responded to questions regarding the reasons for which people typically request to see marriage records. Representative Ragsdale clarified the specific information required by a marriage application and explained the reason for wanting to protect certain personal information through the enactment of House Bill 06-1357. Representative Ragsdale referenced copies of marriage licenses and applications that were distributed to committee members in providing this explanation (Attachment A).

Ms. Linda Salas, Boulder County Clerk and Recorder, and Ms. Carol Snyder, representing the Colorado County Clerks Association, testified in favor of House Bill 06-1357. Ms. Snyder explained the processing of marriage licenses and the information on marriage licenses accessible to the public. Ms. Snyder then explained how the bill would protect certain personal information on marriage licenses from public inspection. Ms. Salas explained the importance of the bill and described how marriage license information is accessed. Ms. Snyder then explained why personal information is often accessed, for both criminal and noncriminal purposes. A discussion ensued regarding geneological research of marriage documents and the use of an affidavit to track identity theft. Ms. Snyder responded to a question regarding protection of personal information on marriage license applications in other states.

Mr. Greg Romberg, representing the Colorado Press Association, testified in favor of amendment L.002 to House Bill 06-1357, which clarifies that marriage licenses and certificates will remain public records. Representative Ragsdale and Mr. Romberg responded to questions regarding the availability of personal information on marriage documents to relatives for the purpose of geneological research. A discussion ensued regarding methods of accessing information for geneological research. Discussion followed regarding the position of the Mormon Church on House Bill 06-1357. Representative Ragsdale clarified the intent of the bill.

Representative Schultheis provided an overview of and background regarding House Joint Resolution 06-1016, concerning the individual interests of members of the General Assembly in pending legislation. Representative Schultheis explained the genesis of the resolution, provided a hypothetical situation that would be covered by the resolution, and referenced prepared amendment L.002 (Attachment C).
