Senator Johnson convened the conference committee on SB 06-198. Kristen Forrestal, Legislative Legal Services, distributed two draft committee reports to the committee, CLSB198.005 and CLSB198.007 (Attachments A and B). Senator Johnson stated the issues that he would like the committee to address including the issues of discrimination that arose in the house and explained the language in the draft reports that addresses this issue. He also explained that the health plans have objected to the portion of the bill that states that a private right of action shall be the enforcement mechanism for the provisions of the bill and asked that the committee adopt language that requires binding arbitration to be the enforcement mechanism for the bill. Representative McGihon moved CLSB198.005, stating that the draft report allows binding arbitration to be the enforcement mechanism, but does not require that it be used. Representative McGihon and Representative Penry discussed the differences between draft reports CLSB198.005 and CLSB198.007 and the benefits and drawbacks of binding arbitration as the enforcement mechanism for the provisions of the bill. Senator Johnson, Representative Penry, Representative McGihon, and Speaker Romanoff discussed whether or not the bill should require binding arbitration as the enforcement mechanism. Representative McGihon withdrew her motion to adopt CLSB198.005.
