02:08 PM -- Senate Bill 06-129 - Concerning Cash Accounting for Programs Under Title XIX of the Federal Social Security Act

Representative Buescher, prime sponsor, explained the provisions of the bill and commented on the savings enumerated in the fiscal note. Representative Buescher said that the bill is recommended by the Joint Budget Committee. It requires the Department of Health Care Policy and Financing to use the cash system of accounting for all non-administrative expenditures that qualify for federal matching funds through Medicaid, but exempts the Indigent Care Program from this requirement. Representative Buescher said that as part of the budget balancing activities in 2003, the General Assembly passed SB03-196 which allowed certain Medicaid programs to use "cash-based" rather than "accrual-based" accounting procedures. This bill will broaden the provisions of SB03-196 to allow all Medicaid medical programs to use cash-based accounting. The accounting change will not affect the amount of claims or payments to providers. This bill only changes when those claims are "booked" for accounting purposes. Representative Buescher closed by saying that with accrual-based accounting, expenses are incurred, or booked, when goods or services are provided, even though bills may be paid at a later date. With cash-based accounting, expenses are incurred when bills are paid.

The following person testified:

02:13 PM -- Ms. Lisa Esgar, Colorado Department of Health Care Policy and Finance, responded to committee questions.

02:17 PM -- Senate Bill 06-020 - Concerning the Creation of a Nurse Licensure Compact

Representative Green, prime sponsor, explained the provisions of the bill and discussed the fees addressed in the fiscal note. Representative Green commented that the bill directs the governor to enter into a multi-state nurse licensure compact. It establishes relationships between party states in the areas of jurisdiction, discipline, and information sharing. Representative Green pointed out that the general provisions of the compact are as follows:

Licenses issued to registered nurses (RNs) or to licensed practical/vocational nurses (LPNs) by a home state shall be recognized by the party states. In order to obtain and retain a license, an applicant must meet the home state's qualifications for licensure and license renewal as well as all other state laws.

Party states may limit or revoke the multi-state licensure privilege of a nurse to practice in their state and may take necessary disciplinary actions. The party state shall notify the home state if disciplinary action is taken.

Every nurse practicing in a party state must comply with the state practice laws of the state in which the patient is located at the time care is rendered.

02:26 PM -- House Bill 06-1336 - Concerning the Uniform Athlete Agents Act

Representative McGihon, prime sponsor, discussed the provisions of the bill and distributed two memoranda (Attachments A and B), amendment L.004 (Attachment C), and a legal memorandum from the Office of Legislative Legal Services on the Scope of the Sunrise Law (Attachment D). Representative McGihon explained that House Bill 06-1336 establishes the Uniform Athlete Agents Act. Athlete agents are required to register with the Secretary of State's office if they intend to represent the commercial or professional interests of an athlete eligible to participate in intercollegiate sports. Registration by an agent is required within seven days of contact with a student athlete. Under certain conditions, reciprocity is granted to athlete agents that have registered in another state. Representative McGihon closed by saying the Secretary of State may refuse to issue a certificate of registration if it is determined that an athlete agent has engaged in conduct that may have an adverse effect on the person's ability to act as an agent.

The following persons testified:

02:40 PM --
Ms. Rose McCool, Department of Regulatory Agencies, testified in opposition toward the bill. There is no evidence that this policy change is needed because current law governs the issues in the bill.

02:56 PM --
Mr. Tom McGrath, University of Colorado at Boulder, testified in support of the bill. This bill will benefit student athletes that may not play professional sports in the future.

The committee discussed the protections in the bill for student athletes and the penalties in the bill that apply to agents. After a committee discussion, Representative McGihon discussed amendment L.004 and Representative Vigil, Chairman, placed the bill on the table for action.

03:19 PM -- House Bill 06-1362 - Concerning Incentives for the Motion Picture Film Industry - (for action only)

Representative Massey and Representative Jahn distributed amendment L.001 (Attachment E), an article entitled State Film Incentivesdated February 10, 2006 (Attachment F), and a Legislative Council Staff memorandum on the fiscal assessment of proposed amendment House Bill 1362_L.001 (Attachment G). Representative Massey said that amendment L.001 responded to the committee's concern regarding the need for an annual cap on the incentives provided for in House Bill 06-1362. He explained that the amendment requires for FY 2006-07 and each fiscal year thereafter, the General Assembly to annually appropriate $1 million from the General Fund to the Commission to be used for performance-based incentives for the motion picture industry. The amendment also requires that no more than 2.5 percent ($25,000) be used for administrative costs associated with the program.
