10:21 AM -- House Bill 06-1330 - Concerning Information Filed with the Division of Insurance by Insurers


Representative Romanoff, prime sponsor, explained the provisions of the bill. Representative Romanoff explained that House Bill 06-1330, as amended by the House Business Affairs and Labor Committee, requires all property and casualty insurers offering policies in the state to submit certain information related to their Colorado line of business. In addition, insurers must specify the states from which experiences were drawn in setting Colorado premium rates.

Ms. Tambor Williams, Department of Regulatory Agencies, testified in support of the legislation but said that there is a conflict in the legislative declaration. Language in the legislative declaration implies that citizens have a role in determining whether rate increases or decreases are excessive or inadequate. Ms. Williams pointed out that under current law, the Insurance Commissioner has this role and asked the committee to strike the legislative declaration to remove the conflict in the bill. After a brief committee discussion, Representative Marshall moved a conceptual amendment to strike the legislative declaration.
