Representative Plant, prime sponsor, presented House Bill 06-1338 which authorizes an area that is contiguous to any boundaries of the Regional Transportation District (RTD) to become part of the district, subject to an election authorized by the district's board of directors. The bill also specifies that the election be requested by a petition signed by a specified portion of eligible electors or by a resolution by the board of county commissioners.

Responding to questions from members, Representative Plant stated that if only part of a county is in the RTD, the entire county may vote to bring the entire county into the district, but if the entire county is not in the District, the county may not vote to bring only part of the county into the RTD.

Wally Pulliam, board member of the RTD, answered questions for the committee and stated that the RTD does not have any issues with the bill as it stands. Members thanked the RTD for sending a representative from the District to answer questions on the bill. Responding to questions from the committee, Mr. Pulliam stated that the Tri-Towns, Frederick, Firestone, and Dacono, in southwest Weld County are possibly interested in entering the RTD.

There was debate among the committee as to whether the bill would allow only the tri-town portion of Weld County to enter the District. Representative Plant clarified that the bill as it is currently written states that a portion of a county may not vote to include itself into the District if there is currently no part of the county already in the District.

Cal Marsella, General Manager for the RTD, commented from the audience that current law already allows a portion of a county to petition to become part of the RTD.

Carol Tone, representing the League of Women Voters (LWV), spoke in support of the bill. Ms. Tone stated that the LWV supports increased transportation alternatives. She further added that the bill expands the reach of the metro area public transportation system, which will result in increased access to jobs and housing.
