The committee came to order. Attendance was taken, and a quorum was present. Representative McCluskey, prime sponsor of HB 06-1011, came to the table for the committee to take action on his bill. (On January 26, the committee heard testimony on the bill, which creates new felony crimes for internet luring of a child and internet sexual exploitation of a child and requires any person convicted of these offenses to register as a sex offender.) Committee members were provided with Amendment L.004 (Attachment A), and Representative T. Carroll explained what the amendment does.

11:38 AM -- House Bill 06-1171

Representative Riesberg, prime sponsor, presented HB 06-1171. The bill makes several changes to the law regarding drunk driving, including lowering the blood alcohol content (BAC) level for the offense of "persistent drunk driver," requiring interlock devices for persons convicted of certain drunk-driving offense, and increasing the minimum surcharge for drunk-driving offenses to $50. The sponsor described some discussions with constituents that led to the bill, and explained why the bill includes certain provisions. He then responded to questions from the committee.

Ms. Maureen Cain, representing the Colorado Criminal Defense Bar, expressed concern with how the bill will be implemented, and noted the difference between convictions for driving under the influence (DUI) and driving while ability impaired (DWAI). She responded to questions from the committee.

Dr. David Timken, representing Timken & Associates, spoke in support of the bill.

11:55 AM --
Mr. Steve Johansen, representing Mothers Against Drunk Driving (MADD), spoke in support of the bill. He distributed information about drunk driving in America (Attachment B).

11:58 AM --
Ms. Christine Byars, representing the Department of Human Services, Alcohol & Drug Abuse Division (ADAD), expressed support for the bill and spoke about effective means of reducing drunk driving.


12:01 PM

The chairman closed the public testimony portion of the hearing. The sponsor indicated that Mr. Terry Campbell, Colorado State Patrol, asked him to express the Patrol's support for the bill. Mr. Stephen Hooper from the Department of Revenue came to the table and answered questions from the committee regarding the interlock device. The chairman laid the bill over for action at a later date.
