11:11 AM -- Call to Order

Senator Takis, Chair, called the meeting to order. She distributed a memorandum, prepared by Legislative Council Staff, concerning fraudulent identification cards, driver's licenses, and motor vehicle titles (Attachment A).

11:11 AM -- House Bill 06-1257

Senator Moe Keller, prime sponsor, explained the provisions of House Bill 06-1257, concerning noise mitigation measures along state highways. The bill allows homeowners living next to a state highway to apply to the Colorado Department of Transportation (CDOT) for the construction of specified noise mitigation measures along the highway if:

The bill creates the Noise Mitigation Fund consisting of moneys transferred from the Waste Tire Recycling Development Cash Fund that would otherwise be credited to the Advanced Technology Fund.

Senator Keller distributed a bill summary sheet for HB 06-1257 (Attachment B). She also distributed prepared amendment L.014 (Attachment C). Senator Keller answered questions from committee members and stated that she has contacted the Colorado Commission on Higher Education regarding the prepared amendment. She also answered questions regarding the Noise Mitigation Fund and stated that the amendment addresses the fund.

Sue McMahon, representing herself, testified in support of the bill. She distributed a table explaining typical activities and sound levels (Attachment D) and a chart addressing levels as a function of speed (Attachment E).

11:36 AM --
Herman Stockinger, representing CDOT, testified in support of the bill. Mr. Stockinger stated that CDOT is open to respond to noise mitigation without affecting CDOT's budget. He indicated that CDOT supports the bill with prepared amendment L.014 (Attachment C). He responded to questions from committee members and stated that CDOT currently uses stone matrix asphalt which is a durable product that has noise mitigation benefits.

Senator Keller made closing comments for HB 06-1257.

Senator Keller responded to questions about additional amendments and stated that she is concerned about jeopardizing the passage of the bill with the addition of an amendment concerning noise mitigation products.
