10:17 AM -- House Bill 06-1020

Senator Entz, prime sponsor, explained the provision of HB 06-1020, concerning the issuance of special license plates for motor vehicles valued by collectors due to their early date of manufacture. The bill defines the phrase "early date of manufacture" for the purpose of registering collectors' motor vehicles that are at least 50 years old. It also requires the executive director of the Department of Revenue to register collectors' motor vehicles for 5 years.

10:25 AM -- House Bill 06-1007

Senator Williams, prime sponsor, explained the provisions of HB 06-1007, concerning the transfer of a motor vehicle to a person not licensed as a motor vehicle dealer for the purpose of scrapping the motor vehicle. The bill prohibits a person who purchases or otherwise receives a motor vehicle or a numbered motor vehicle part for the purposes of scrapping the motor vehicle or part, unless the person receives specified documents. It also requires the person to contact a local law enforcement agency to see if the motor vehicle or part was stolen. Senator Williams distributed prepared amendment L.004 (Attachment A) and a newspaper article concerning scrapping of motor vehicles (Attachment B).

R.J. Hicks, representing the Scrap Recyclers and Auto Recyclers of Colorado, testified in support of the bill. He stated that the reengrossed version of HB 06-1007 limits who Scrap and Auto Recyclers can purchase vehicles from. In addition, he stated that the Scrap Recyclers and Auto Recyclers of Colorado support the amended version of the bill. Mr. Hicks answered questions from committee members and stated that the purchaser and dealer regarding vehicles for the purpose of scrapping must be a licensed motor vehicle dealers unless the seller or transferor is the owner on the certificate of title, an operator, or a licensed motor vehicle dealer.

Terry Campbell, representing the Colorado State Patrol, testified in support of the bill. He stated that the current law does not require proof of ownership when purchasing or selling a motor vehicle for scrapping purposes.

Senator Williams stated that the bill requires a certificate of title when purchasing and selling for the purposes of scrapping. She also stated that prepared amendment L.004 (Attachment A) also requires that a bill of sale be required.


10:47 AM -- Mr. Ford continued answering questions and stated that the towing companies are required to check the VIN numbers of vehicles when processing.

Senator Wiens stated that he feels that the bill restricts small businesses from selling motor vehicles for scrapping purposes. Senator Williams responded by stating that the bill requires proof of ownership by a title certificate before selling a motor vehicle for scrapping purposes.

Detective Tom Davis, representing the County Sheriffs of Colorado, testified in support of the bill. He stated that bill's intent is to limit who can salvage vehicles and to protect vehicle owners from individuals who have stolen vehicles from being able to salvage such stolen vehicles. Detective Davis responded to questions and stated that individuals who have purchased vehicles with a bill of sale from a private sale should obtain a title of certificate.

Terry Campbell came back to the table to respond to additional questions and stated that operators of salvage yards are not required check VIN numbers before they are crushed. He also stated that HB 06-1007 does not address motor vehicle parts.

11:23 AM -- Senate Bill 06-192

Senator Groff, prime sponsor, explained the provisions of SB 06-192, concerning a task force on drunk driving. The bill creates a 10-member task force to study the regularity of drunk and impaired driving incidents and specifies membership on the task force. The task force is required to meet regularly to investigate methods of reducing the incidence of drunk driving and to develop recommendations to the General Assembly. He distributed prepared amendments L.002 (Attachment C) L.003 (Attachment D) and L.004 (Attachment F).

Gaylen Matzen, representing Mother Against Drunk Drivers (MADD), testified in support of the bill. She stated that SB06-192 will make the roads and highways of Colorado safer.

Patsy King, representing herself, testified in support of the bill. She told her personal story of the death of her brother by a drunk driver in 1999.

Senator Groff made closing comments for SB 06-192 and answered questions from committee members concerning who has the authority to appoint the member of the task force. He stated that the bill states who will serve on the task force. Committee discussion ensued regarding the appointees to the task force.
