Representative A. Kerr, sponsor, presented the bill regarding the authority of the Department of Human Services' Division of Alcohol and Drug Abuse (ADAD) to regulate treatment facilities. A copy of a bill summary and an administrative law judge's (ALJ) opinion on ADAD's authority over private sector substance abuse treatment programs were distributed to committee members (Attachments B and C).

Richard Kaufman, Denver Behavioral Health, described a February ALJ decision regarding ADAD's authority over private treatment facilities. The decision cast doubt on ADAD's authority. Mr. Kaufman stated the bill creates new regulations of professionals and therefore is subject to sunset requirements.

Wade Livingston, Attorney General's Office, discussed dangers associated with distributing controlled substances. He stated the bill will help protect public safety.

Janet Wood, ADAD, discussed a current review of ADAD regulations. She stated there are approximately 10 methadone programs in Colorado. Four are private.

Bill Wendt, Signal Behavioral Health Network and Colorado Association of Drug Service Providers, spoke in support of the bill.
