The conference committee on House Bill 06-1006, concerning referral by an insurance company of an insured to a personal property repair business, was called to order. Representative Butcher distributed proposed Conference Committee Report CLHB1006.001 (Attachment A). She walked the committee through the two proposed changes offered in CLHB1006.001.

Representative Butcher explained that the first change would strike the Senate's amendment that added the provision that the consumer may freely choose any qualified and insured repair business. She stated that she did not feel that the words qualified and insured needed to be included in the bill because it might interfere with consumers who want to fix their own property. There was a discussion about how qualified and insured would be defined. The committee considered changing the word qualified to licensed or registered. Representative Butcher stated that the intent of her bill was to keep the law as it is and simply add personal property to the statute. The committee agreed to strike the words qualified and insured from the bill as proposed in CLHB1006.001.

Representative Butcher explained the second change offered in CLHB1006.001 dealing with the provision in the bill that was added by the Senate that allows the insurer to recommend a repair business that is located near the beneficiary or claimant or that meets or exceeds industry standards of quality, service, or safety. There was committee discussion about what the industry standards are. Representative Butcher explained that CLHB1006.001 would strike the language offered by the Senate and substitute that the insurer may recommend a repair business to a beneficiary or claimant upon request by the beneficiary or claimant. The committee agreed to the change.
