Representative McFadyen, prime sponsor, presented House Bill 06-1039. The bill allows an on-premise advertising device located within a comprehensive development to advertise any activity conducted in the comprehensive development.

Herman Stockinger, legislative liaison for CDOT, spoke in support of the bill. Mr. Stockinger addressed amendment L.001 (Attachment B), which modifies specific terms in the bill to comply with Federal Highway Administration language.

Responding to the question about local zoning issues, Mr. Stockinger stated that for areas which are under federal jurisdiction, federal law supersedes local zoning codes and regulations.

The legislation allows businesses within a commercial development that are outside the viewing range of major roads and interstates to advertise on other sections of the development not necessarily owned by the business.
