Senator Takis, chair, called the meeting order. She distributed a memorandum from the Department of Revenue (DOR) concerning special license plates (Attachment A).

02:04 PM -- House Bill 06-1039

Senator Hagedorn, prime sponsor, explained the provisions of SB 06-1039, concerning the placement of on-premise advertising devices at comprehensive developments. Under current law, certain types of advertising devices are restricted for use in highway right-of-way by federal statues and agreements, including any signs or devices advertising activities conducted on the property on which the are located. Federal law indicates that states that do not provide for the effective control of signs along the interstate highway system could lose 10 percent of federal highway funding. Senator Hagedorn distributed prepared amendment L.002 (Attachment B).

02:11 PM -- House Bill 06-1016

Senator Spence, prime sponsor, explained the provisions of HB 06-1016, concerning the issuance of a temporary registration or commercial movers of household goods. The bill authorizes the Motor Carrier Services Division in the Department of Regulatory Agencies to issue, through a port of entry weigh station, a one-time temporary household mover registration. The temporary registration is valid for 15 consecutive days, but may not be renewed or re-issued.

The following persons testified:

02:17 PM --
Terry Willert, representing the Public Utilities Commission (PUC), came to the table to answer questions. He responded to questions and stated that the temporary registration is valid for 15 days to allows driver's sufficient time to purchase a permanent permit. He also stated that the HB 06-1016 is designed to address individuals who move household goods for business. Mr. Willert stated that the full registration fee is $300 annually and the application cannot be completed on-line.

02:27 PM

Senator Wiens explained that the bill does not apply to individuals who are moving personal items but applies to people who are moving household goods for business purposes. Senator May expressed concern about the bills effects on military personnel living on a military base who are moving from one place to another.

02:30 PM -- Greg Fulton, representing Colorado Motor Carriers Association (CASTA), testified in support of the bill. He stated that CASTA represents household movers across the state and many complaints from the Better Business Bureau involve household movers. Mr. Fulton explained that HB 06-1016 is designed as a tool to reduce complaints regarding household movers. He also stated that the 15 days is adequate time to complete a single move and to obtain a full permit if they continue moving household goods.

Terry Willert came back to the table to answer additional questions and stated that the temporary registration is an alternative to a fine. He also explained that the "identification fee" is a $5 annual fee. Mr. Fulton indicated that CASTA would be open to an amendment that would protect military personnel. Senator Spence indicated she would discuss an amendment with the drafter of the bill.

Senator Spence made closing comments for HB 06-1016. She stated that she would be willing to work with Senator May regarding his concerns.

Senator Takis announced that HB 06-1016 is laid over and will be heard for action only on Tuesday, March 7.

02:51 PM -- House Bill 06-1035

Senator May, prime sponsor, explained the provisions of HB 06-1039, concerning motor vehicles required to stop before crossing at grade railroad tracks. The bill expands the type of vehicles that must stop at railroad grade crossing. Under current law, school buses and vehicles carrying hazardous materials must stop before crossing railroad tracks. It also requires commercial vehicles that transports passengers to stop before crossing railroad tracks. All three types of vehicles would be required to stop before crossing street railroad tracks in a residential area, and to stop even when a railroad crossing has a gate or flashing lights. Senator May stated that HB 06-1035 came out of the Transportation Legislation Review Committee.

Terry Campbell, legislative liaison, Colorado State Patrol, testified in support of the bill. He explained that HB 06-1039 is consistent with federal law. Mr. Campbell answered questions from committee members and stated that HB 06-1035 applies to all areas in Colorado.
