Senator Takis, Chair, called the meeting to order.

Senator Isgar, prime sponsor, explained the provisions of SB 06-010, concerning the appearance of a commercial vehicle's owner in a court hearing concerning a permit or documentation violation. The bill amend statutory provisions regarding the violation of commercial vehicle permitting or documentation. Under current law, a person committing a violation of Title 42, Vehicles and Traffic, C.R.S., punishable as a misdemeanor, pretty offense, or misdemeanor traffic offense, may be served a summons and complaint and directed to appear in a specified county court. This person has generally been the commercial vehicle operator. Senator Isgar also explained a prepared amendment L.001 (Attachment A) that strikes everything below the enacting clause and substitutes different language (Attachment A). Amendment L.001 requires that the Department of Transportation to provide the option to a company filing for a permit to file a consent waiver that enables the company to designate a company representative to be a party of interest for a violation. Senator Isgar also stated that SB 06-010 came out of the Transportation Legislation Review Committee.

R.J. Hicks, representing Colorado Motor Carrier Association, testified in support of the bill. Mr. Hicks explained prepared amendment L.001 (Attachment A). Mr. Hicks answered questions from committee members.

Senator Isgar made closing comments for SB 010 and stated that the it is necessary to continue looking into the process further. He also said that amendment L.001 (Attachment A) may require a revised fiscal note. Senator Isgar asked that the bill be laid over until the revised fiscal note is complete.

10:02 AM -- Senate Bill 06-083

Senator May, prime sponsor, explained the provisions of SB 06-083, concerning authorization for an alternate person to supervise a holder of a driver's permit issued to a minor who is under 16 years of age. The bill authorizes a parent, a stepparent, grandparent, or guardian, who signs a minor's instruction permit but does not have a driver's license, to appoint an alternate permit supervisor. SB 06-083 requires the alternate permit supervisor to be 21 years of age or older and a licensed driver. Senator May distributed a bill summary sheet for SB 06-083 (Attachment B).

10:04 AM -- Senate Bill 06-094

Senator Spence, prime sponsor, explained the provisions of SB 06-094, concerning the regulation of motor carriers by the public utilities commission. The bill updates state law to comply with the federal Unified Carrier Registration Act of 2005.

The following person testified.

Terry Willert, Chief of Transportation, Public Utilities Commission (PUC), testified in support of the bill. He explained that the bill will allow the PUC to continue to administer the unified carrier registration system. Mr. Willert also explained that the bill eliminates obsolete language. Mr. Willert responded to questions from committee members and stated that PUC establishes the registration fees in accordance with federal law. He also explained that the PUC is part of a safety and advisory council that addresses the issues of insurance and registration.

Greg Fulton, President, Colorado Motor Carrier Association (CMCA), testified in support of the bill. He explained that the CMCA has concern about non-registered commercial vehicles. Senator May stated that he would be willing to work with CMCA regarding non-registered commercial vehicles and bring it forward to the Transportation Legislation Review Committee in the interim.
