Senator Taylor, prime sponsor, reviewed the provisions of Senate Bill 06-233, concerning the clarification of the existing authority of the state auditor to access confidential documents. He distributed a document outlining the provisions of the measure (Attachment A).

Senator Tochtrop, prime sponsor, reviewed the provisions of House Bill 06-1314, concerning a prohibition against certain employer communications to an employee. Senator Tochtrop clarified that this bill does not prevent employers from calling meetings related to political affiliation or religious matters, instead only provides that these meetings cannot be mandatory.

Senator Lamborn, prime sponsor, reviewed the provisions of House Bill 06-1365, concerning practices related to state budgeting, and, in connection therewith, establishing a performance-based budget for state fiscal years commencing on and after July 1, 2009, and requiring budget savings from the same state fiscal years to be transferred to the Colorado fiscal responsibility fund to be saved and used only during economic downturns to stabilize funding for state programs and to prevent cuts in essential services or layoffs of state personnel. The committee discussed performance-based budgeting, and the difference between this fund and a rainy day fund.

She spoke to the formula used for this bill, and how it conflicts with agreements made by the inter-jurisdictional committee negotiations. The committee asked Ms. Snyder to explain the negotiation process and the compromise they offered. The committee discussed the formula the county clerks used to bill the SCFD.

Senator Groff, prime sponsor, reviewed the provisions of Senate Bill 06-234, concerning best value construction contracting for public projects procured by the state. He said that it would bring additional accountability for public dollars for construction dollars.

Dennis Jakubowski, representing the Associated General Contractors of Colorado, testified in opposition to the bill. He said that his organization feels that the bill is unnecessary. He said that there are accountability measures already built into state contracting for construction.

Senator Sandovol, prime sponsor, reviewed the provisions of Senate Bill 06-235, concerning public employees' retirement benefits plans.

Greg Smith, representing the Public Employee Retirement Association (PERA), testified in favor of the bill. He distributed two handouts outlining the provisions in the measure (Attachment E and F). Mr. Smith walked the committee through the documents and responded to questions from the committee. Senator May asked specific questions regarding how this bill will impact PERA members. Senator Tupa asked how the bill will impact different groups of PERA members. Senator May asked Mr. Smith to explain to the committee what would happen if no legislation is passed.

Judge James Casebolt, Chairman of the PERA board, testified in favor of the bill. He informed the committee that the PERA board met on April 25, 2006 and voted in favor of the measure. Senator Fitz-Gerald asked about the PERA board and the membership and training of the board.

Deputy Treasurer Benson Stein testified against the bill, and distributed a document (Attachment G). He opposes the growth of the board.

Christine Burt, representing the Americans for Prosperity Foundation, testified in opposition to the bill. She spoke to concerns she has regarding employment reliability. She also spoke to the benefits of a defined contribution plan. She also said that she believes PERA's proposal is unrealistic.

He distributed amendment L.001, a strike below the enacting clause amendment (Attachment I). He spoke about the changes to the board membership and the voluntary extension of the defined contribution plan to other divisions under PERA.
