Representative Clapp, bill sponsor, explained the provisions of HB 06-1111 regarding attorney fees against parties who engage in unjustifiable conduct in divorce cases.

Michael DiManna, Colorado Bar Association, spoke in opposition to the bill. He reviewed the provisions of current Colorado law allowing the court to award attorney fees in divorce cases when deemed appropriate by the court. He indicated that Colorado Rules of Civil Procedure also provide for such awards of attorney fees. In response to a committee question regarding prepared amendment L.001 (Attachment U), Mr. DiManna indicated the process outlined in the amendment is cumbersome and difficult and may not accomplish the desired result.
