11:36 AM -- Senate Bill 06-061

The committee came to order. A quorum was present. Representative Larson, prime sponsor, explained SB 06-061 and its impact. The reengrossed bill transfers authority from the Division of Rehabilitation to the Colorado Commission for the Deaf & Hard of Hearing, both of which are in the Department of Human Services, for overseeing the provision of interpreters and auxiliary services for persons who are deaf or hard of hearing. The bill also identifies the circumstances under which an interpreter or auxiliary services are to be provided; includes a definition of "deaf or hard of hearing"; and specifies that a person who is deaf or hard of hearing may have access to counsel for advice, and must have knowledge of the right to effective communication before waiving qualified interpretation services. Committee members were provided with a fact sheet on the bill (Attachment A), and Amendment L.012 (Attachment B). The sponsor walked the committee through the bill and, with the chairman's permission, explained L.012.

11:53 AM -- Senate Bill 06-022

Representative Penry, prime sponsor of SB 06-022, described the bill's provisions. The bill requires community notification of all sexually violent predators who are released into the community (and makes related notification requirements), broadens the definition of sexually violent predator, qualifies out-of-state sexual offenses for designation as a sexually violent predator in Colorado, requires that assessment to determine whether someone is a sexually violent predator be done at the time of sentencing and prohibits such assessment from being waived, and mandates the arrest of sexually violent predators who have failed to register with law enforcement.

Ms. Nancy McGuire, representing herself, spoke against putting sexually violent predators on a community notification list because it violates their privacy and inhibits their ability to move on with their life once they are released. Representative Penry clarified that the bill only targets violent predators who have met a number of criteria, not generic sexual offenders.
