Senator Sandoval introduced Senate Bill 06-199. She explained that the bill adds new definitions to the child care licensing act, clarifies existing definitions, allows a facility to be certified as a foster care home and a family child care home (dual licensing), permits the Department of Human Services to collect overdue fines, and allows the department to prescribe standards for the training of providers of cradle care home services. She distributed amendment L.001 (Attachment B) to the committee.

Peg Long, Colorado Association of Family and Children's Agencies, testified regarding the portion of the bill that permits a home to be licensed as both a foster care and day care home. She explained that the bill creates two separate licenses so that a person does not have to give up a day care license in order to be a licensed foster care provider. She responded to questions from the committee regarding dual licensing. She explained that the provisions of the bill are aimed primarily at persons who want to serve as foster parents so that they may later adopt the child.

Terry Santi, Division of Child Care with the Department of Human Services, responded to questions from the committee regarding whether a dual licensed home must comply with existing limitations on the number of children permitted to be cared for in a foster home or family day care home. Ms. Santi explained that a dual licensed home would have to comply with the existing limitations and that the number of foster children in the home counts toward the total number of day care children permitted to be cared for in one home. She responded to questions from Senator Sandoval regarding cradle care homes.

Carla Bennett, representing herself, testified in support of the bill. She testified regarding her concerns with the definition of cradle care homes and regarding the process of relinquishment. She responded to questions from the committee regarding permanency plans for infants. Senator Sandoval responded to questions from the committee regarding training for cradle care parents. Ms. Bennett discussed how the current licensing process will be affected by the provisions of the bill.

Ms. Long returned to the table to address amendment L.001 (Attachment B). She responded to questions from Senator Johnson regarding how long a child may remain in cradle care and training for cradle care foster parents, stating that most cradle care homes only care for infants for a matter of weeks. She responded to additional questions from Senator Johnson regarding how long the development of an expedited permanency plan currently takes.
