Representative McGihon, sponsor, presented the bill regarding the Colorado Air Quality Control Commission's authority to adopt clean air measures more stringent than federal standards. She discussed changes to the State Implementation (SIP) legislators considered in 2005 and recent occurrences of smog, brown cloud, and high mercury levels in Colorado. She stated the bill will improve the Commission's ability to ensure clean air. She discussed Colorado law addressing control of mercury emissions. She stated cleaner air will promote Coloradans' health. Representative McGihon answered questions about how the bill might be "good for business," costs associated with implementing the bill, and the Commission's rule-making authority. Representative Berens discussed local government's interest in air quality standards. Representative Boyd discussed legislative oversight of changes to the SIP. Representative Berens distributed a letter to members (Attachment A).

Toni Gagliardi, National Federation of Independent Businesses, stated his opposition to the bill. He said the bill will open the door to litigation against small businesses. Representative Lundberg asked questions regarding the effect of rule changes on small businesses. Mr. Gagliardi answered questions about cost-benefit analyses of rule changes.





02:23 PM -- Jim Sanderson, Colorado Petroleum Association, Platte River, and Tri-state Colorado Springs Utility, stated his opposition to the bill. He discussed current state law regarding changes to the SIP and legislative review of the plan. He described state-only and federally-enforceable air quality regulations.

02:31 PM -- Landon Gates, Colorado Farm Bureau, stated concerns the Bureau has with the bill's provisions. These include possible increased costs to farm productions.

Thor Nelson, Colorado Association of Commerce and Industry (CACI), discussed CACI's membership and stated his opposition to the bill. He stated the current practice of adopting federal regulations offers benefits such as a level playing field among businesses in different states. Opportunities and jobs will be lost if Colorado's air quality standards are more stringent than other states' standards. He answered questions about the federal Clean Air Act and local government control over air quality regulations.

Representative May, sponsor, presented the bill creating a state-wide smoking ban for indoor areas. A fiscal memo regarding amendments L.008 and L.013 and the following amendments were distributed to members: L.007, L.009, L.011, and L.012 (Attachments D, E, F, G, and H). He discussed problems businesses' experiences with smoking policies and laws that vary among municipalities. Members discussed the possibility of a future citizen initiative to ban smoking and the effect of a ban on certain businesses. He described the current variety of smoking bans among cities and counties as creating disadvantages for some businesses.

He stated his tavern's success depends upon the success of other businesses like his. Representative Boyd, sponsor, presented the bill regarding annual license fees for retail food establishments. She distributed amendment L.001 (Attachment O). The amendment sets limits on how much license fees can grow year-to-year. She stated the bill allows license fees to be established by rule. Currently, a fee schedule is established in statute. The bill also allows local governments to set their restaurant license fees. Representative Boyd stated the bill allows more local control. She answered questions about Denver's exemption from the bill's provisions. She stated Denver has historically set its own restaurant license fees. Amendment L.002 was distributed to members (Attachment P).

The Association is OK paying part of fees but not the full cost of inspections. He stated the average restaurant profit is 3.6 percent. Representative Riesberg suggested that smaller restaurants required greater assistance with following safety standards.

09:07 PM -- House Bill 06-1127

Representative Riesberg, sponsor, presented the bill regarding new regulation of athletic trainers (ATs). Amendments L.003 and L.004 were distributed to members (Attachments S and T). Representative Riesberg discussed certified athletic trainers and his desire to set them apart from less qualified trainers. He stated ATs practice in a variety of settings and treat a variety of persons. He described provisions of the bill, including specific definitions, scope of practice, and exemptions. He stated 31 states currently require athletic trainers be licensed. He answered questions about populations served by athletic trainers and the Colorado Medical Association's position on the bill.

Brian Tobias, Department of Regulatory Agencies (DORA), spoke in opposition to the bill. He described criteria for sunrise reviews, including determining if the public is being harmed. The Department has not received complaints against athletic trainers. There has been so little harm that the Department believes that athletic trainers should be able to treat additional populations of athletes.

Susan Miller, State Board of Medical Examiners, Department of Regulatory Agencies, spoke in opposition to the bill. She stated that in her 12 years with the board, she has received no complaints against an athletic trainer. She stated the bill's provisions are inconsistent with other health professional oversight provisions. She also stated the bill is inconsistent with other regulatory law. She answered questions about complaints received by DORA.

Ellen Caruso and Audry Waldron, American Physical Therapy Association (APTA), distributed a packet of information to members (a copy was not made available to staff). Ms. Caruso stated her support for L.004. Ms. Waldron stated reasons for the Association's opposition to the bill, including a broadening of the practice of athletic training. She stated a number of persons in the audience have been trained as both athletic trainers and physical therapists (PTs). She said the education and training of athletic trainers is much more limited than the education and training of PTs.
