Senator Grossman, sponsor, presented House Bill 06-1353 concerning the development of standards for the performance of competency evaluations in criminal cases. The bill requires the Task Force for the Continuing Examination of the Treatment of Persons with Mental Illness who are involved in the criminal and juvenile justice systems to study competency evaluations in criminal cases. To accomplish this, the task force chairpersons shall create a subcommittee made up of nine members including mental health experts, and representatives from the Department of Human Services, Division of Mental Health, district attorneys, and public defenders. The subcommittee shall study the types of mental health professionals qualified to perform competency evaluations and necessary training and experience. It may also recommend statutory or regulatory changes to implement competency evaluation standards. The subcommittee must consider these standards on or before September 15, 2006.

Kim Robbins, Colorado District Attorneys' Council, spoke in favor of the bill. She explained that the district attorneys support standardization of criminal competency evaluations and talked about some problems with evaluations that were completed by psychologists.

Larry Botnick, Colorado NASW, spoke in favor of the bill. Mr. Botnick discussed the importance of standardizing criminal competency evaluations and talked about other states that have already standardized.
