Senator Takis called the meeting to order and distributed the proposed FY 2006-07 budget allocation plan for the Colorado Department of Transportation (CDOT) (Attachment A).


02:05 PM -- Senate Bill 06-008

Senator May introduced SB 06-008, concerning the regulation of commercial motor vehicles that transport hazardous materials over the public highways. He distributed a bill summary sheet explaining the provisions of the bill (Attachment B).

Mr. Terry Campbell, Legislative Liaison, Colorado State Patrol, testified in support of the bill. He explained that the bill came out of the Transportation Legislation Review Committee and further explained the provisions of the bill. Mr. Campbell answered questions from committee members and explained that the definition of hazardous materials includes the various classification and handling of such materials. He also explained that the bill establishes provisions consistent with federal law.

Senator Isgar expressed concern about the effect of the bill's provisions on farmers who transport fertilizer. Mr. Campbell responded by clarifying that no new categories of hazardous materials are created by the bill. He further explained that the bill only applies to commercial vehicles. He also stated that individuals transporting quantities of hazardous materials required under federal law (49 CFR, Parts 172 and 173) must possess an appropriate placard.

Senator May requested that Mr. Campbell come back to the committee and provide a briefing on the routes in Colorado that allow the transport of hazardous materials.

Senator Takis reminded the committee of the Joint Transportation Committee meeting on January 26, 2006, upon adjournment, in House Committee Room 0112. The meeting will include presentations by the Joint Budget Committee and CDOT. She asked that members submit questions for the CDOT to staff. Further discussion ensued.
