02:26 PM -- House Bill 06-1336 - Concerning the Uniform Athlete Agents Act

Representative McGihon, prime sponsor, discussed the provisions of the bill and distributed two memoranda (Attachments A and B), amendment L.004 (Attachment C), and a legal memorandum from the Office of Legislative Legal Services on the Scope of the Sunrise Law (Attachment D). Representative McGihon explained that House Bill 06-1336 establishes the Uniform Athlete Agents Act. Athlete agents are required to register with the Secretary of State's office if they intend to represent the commercial or professional interests of an athlete eligible to participate in intercollegiate sports. Registration by an agent is required within seven days of contact with a student athlete. Under certain conditions, reciprocity is granted to athlete agents that have registered in another state. Representative McGihon closed by saying the Secretary of State may refuse to issue a certificate of registration if it is determined that an athlete agent has engaged in conduct that may have an adverse effect on the person's ability to act as an agent.

Ms. Rose McCool, Department of Regulatory Agencies, testified in opposition toward the bill. There is no evidence that this policy change is needed because current law governs the issues in the bill.

Mr. Tom McGrath, University of Colorado at Boulder, testified in support of the bill. This bill will benefit student athletes that may not play professional sports in the future.

The committee discussed the protections in the bill for student athletes and the penalties in the bill that apply to agents. After a committee discussion, Representative McGihon discussed amendment L.004 and Representative Vigil, Chairman, placed the bill on the table for action.
