The meeting was called to order by the chairman, Speaker Romanoff. He described how the committee would proceed with its consideration of interim study committees.


08:10 AM

Kirk Mlinek, Director, Legislative Council Staff, came to the table to provide an overview of the interim process. He described the authority of the Legislative Council in prioritizing interim study committees. He referred the committee to a memo, prepared by Legislative Council Staff, that outlines the proposals before the committee (Attachments A and B). Mr. Mlinek explained the issues involved with several of the measures that require legislative staffing.

Representative Solano and Senator Teck came to the table to address House Bill 06-1145. Representative Solano described the bill, which creates a task force to study the prevention, intervention, and treatment of the abuse of methamphetamine. She described amendments made to the bill in the Senate, including an amendment that eliminates the Legislative Oversight Committee, rolling it into the task force. Senator Teck spoke to the amendments made to the bill in the Senate. He noted that provisions in the bill requiring legislative staff involvement would be removed and the task force would be staffed by the Attorney General's Office.

Senator Tupa described Senate Bill 06-046 and Senate Joint Resolution 06-042, which create task forces to study the creation and implementation of an integrated system of education stretching from pre-kindergarten through higher education (P-16). He noted that the bill and the resolution contain nearly identical language and explained his intent in offering both the bill and the resolution. Senator Tupa defined the term "P-16" and described the funding of the study. He responded to questions from the committee regarding the make-up of the task force and the study. Senator Tupa noted that 35 states have implemented a P-16 education council or study.

Senator Tupa, in response to a question from the Speaker, noted that the bill and the resolution need to be together.

Representative Vigil described House Bill 06-1307, which creates a task force to study matters related state government accountability. He commented on the need for measurable goals and benchmarks and described the citizen input in the committee. Representative Vigil responded to questions and comments from the committee.

Representative McGihon described House Bill 06-1258, which creates an interim committee to study the adoption of the Uniform Trust Code. She said the purpose of the committee is to address issues between the Uniform Trust Code and Colorado law. Representative McGihon responded to questions from the committee. She told the committee who the Colorado Uniform Laws Commissioners are. Representative McGihon described the make-up of the interim committee and the reason for that make-up. In addition, she responded to questions about opposition to the Uniform Trust Code.

Representative Stafford described House Joint Resolution 06-1029 and House Joint Resolution 06-1030. House Joint Resolution 06-1029 creates a legislative committee to study the regulation of mortuary science. She provided a packet of information to the committee (Attachment C). The 10-member interim committee would meet 4 times over the interim. Representative Stafford responded to questions from the committee.

House Joint Resolution 06-1030 creates an interim committee to study domestic violence offenders. Representative Stafford described the "one-size-fits-all" model in Colorado and inconsistencies among jurisdictions in Colorado regarding arrests. In addition, she said, treatment is "one-size-fits-all." Representative Stafford responded to questions from the committee.

Representative Pommer described the Tax Increment Financing Task Force created in House Bill 06-1375, the school finance bill. He said the task force was added to the bill in the Senate. Representative Pommer described the issues at stake. The committee discussed issues surrounding the task force, given that the bill is on the Governor's desk awaiting signature. Representative Pommer commented. The Speaker explained that the committee would exclude the bill from consideration.

Representative Garcia described an amendment to Senate Bill 06-221 that would create an interim committee to study two issues related to trauma care (SB221_L.004 Attachment D). He described how the proposed committee is different from the Auto Insurance Interim Committee and responded to questions.

Charley Pike, Director, Office of Legislative Legal Services, came to the table to address questions about the school finance act and the Governor's veto power in relation to the act. Senator Windels commented on inclusion of House Bill 06-1375 in the deliberations of the committee.
