Representative Penry, prime sponsor of SB 06-022, described the bill's provisions. The bill requires community notification of all sexually violent predators who are released into the community (and makes related notification requirements), broadens the definition of sexually violent predator, qualifies out-of-state sexual offenses for designation as a sexually violent predator in Colorado, requires that assessment to determine whether someone is a sexually violent predator be done at the time of sentencing and prohibits such assessment from being waived, and mandates the arrest of sexually violent predators who have failed to register with law enforcement.

Ms. Nancy McGuire, representing herself, spoke against putting sexually violent predators on a community notification list because it violates their privacy and inhibits their ability to move on with their life once they are released. Representative Penry clarified that the bill only targets violent predators who have met a number of criteria, not generic sexual offenders.
