10:07 AM -- House Bill 06-1337

Representative Butcher, sponsor, described the provision of HB 06-1337 concerning penalties against violators of water quality laws. She also identified civil penalties for such violations in other western states.

The following persons testified on the bill:

Chuck Ford, Southeastern Colorado Water Conservancy District, described water quality problems in the Arkansas River Basin and explained that the district has not taken a position on the bill.

10:14 AM --
Howard Roitman, Colorado Department of Public Health and Environment, explained that the department has not taken a position on the bill and responded to questions from the committee regarding costs associated with administering grants from the water quality improvement fund. He also described the use of moneys from penalties under current law.

Committee discussion followed about fines collected by the Water Quality Control Division and the use of these moneys to pay for water quality improvements (Attachment B). It also discussed the potential impacts to water providers from increasing civil penalties for violations of water quality requirements. The bill was laid over and tentatively scheduled for action only on Monday, February 27, 2006 at 1:30 PM or upon adjournment.
