12:10 PM -- Senate Bill 06-037

Representative Curry explained that the committee will not take action on SB 037 concerning recreational in-channel diversions (RICD). Testimony was also taken at the March 22 and March 20 committee meetings.

The following persons testified on the bill:

Steve Bushong, Chaffee County, spoke in opposition to the bill and explained that he represented the City of Golden' water rights application for its white water recreation facility on Clear Creek. He described efforts to reach a compromise with opponents of Chaffee County's RICD application and responded to questions from the committee. He also described construction of RICDs to handle high and low flows in a river.

Drew Peternell, Colorado Trout Unlimited, spoke in opposition to the Section 3 of the bill concerning the 85 percent threshold for calling for a water right and the water court's retained jurisdiction over RICDs. He also described incidental benefits that are provided by RICDs for fisheries.

Jon Khan, representing himself, described the economic benefits provided by RICDs.

Representative McFadyen, sponsor, described the provisions of SB 06-194 concerning youth hunting licenses.
