Representative Paccione presented SB05-137 which allows consumers to request that credit reporting agencies place, temporarily lift, and remove a security freeze on the consumer's credit report. Representative Paccione handed out information on identity theft victim complaint data (Attachment B). She also presented amendment L.030 (Attachment C) to the committee.

Bob Oblock, representing himself as a private investigator, testified in opposition to the bill. Mr. Oblock testified that persons in his profession need access to credit information that would be unavailable under this bill. Mr. Oblock responded to questions from the committee.

Anthony Mastin, representing himself as a private investigator, testified in opposition to the bill. Mr. Mastin testified that costs associated with notifications required by the bill will be borne by consumers.

Edward O'Connor, representing himself as a private investigator, testified in opposition to the bill.

Terry Faulke, representing himself as a private investigator and the Retired Peace Officers of Colorado, testified in opposition to the bill. Mr. Faulke would like to see an exception in the bill for private investigators to be able to access credit information. Representative Marshall asked Mr. Faulke how private investigators are regulated in Colorado. Mr. Faulke responded that they are not regulated. Representative Marshall expressed her concern with exempting them since anyone could pose as a private investigator.

Rex Wilmouth, representing the Colorado Public Interest Research Group, testified in favor of the bill. Mr. Wilmouth responded to questions from the committee.

Tom Swanson, representing the American Association of Retired Persons, testified in favor of the bill.

Peg Ackerman, representing the County Sheriffs of Colorado, testified in favor of the bill.

Mike Feeley, representing the Consumer Data Industry Association, testified in favor of the bill. Mr. Feeley testified that amendment L.030 makes the statutes consistent regarding cross-references and makes changes to the original draft in order to make Colorado's legislation consistent with other states with similar laws.
