The bill expands the definition of corporation to include nonprofits and organizations incorporated under the laws of another state or foreign country; prohibits a limited liability company from contributing to a candidate committee, small donor committee, political party, or political committee if any members of the LLC is prohibited from making such a contribution; and, makes further changes.

02:33 PM -- Senate Bill 05-198

Representative Madden, prime sponsor, introduced Senate Bill 05-198 regarding the conduct of elections. This measure offers a variety of changes to election rules, including;

• expanding the list of the types of documents that may be used to establish an elector's identification for purposes of the "Uniform Election Code of 1992";
• entitling each eligible elector to inspect, verify, and correct voter-verified permanent paper record of his or her votes at the time the vote is cast; and
• requiring the Secretary of State to initiate a surprise random audit.

She reviewed the provisions of the bill. Rep. Madden responded to committee questions.

The following people testified:

02:49 PM -- Scott Doyle, representing the County Clerk's Association, testified in opposition of the bill. He noted that the county clerk's are typically the workhorse of Colorado election and the technology to perform the tasks in this bill are still not identified or familiar to the county clerks. He responded to committee questions regarding the procedures used by the county clerks, and the meetings the clerks association has had with the sponsor, Rep. Madden, to resolve matters related to the bill.

03:06 PM -- Karon Hatchett, representing the Denver Election Commission, testified in opposition of the bill. She indicated that the Denver election commission will not receive reimbursing Denver for the requirements made in this bill. She stated that this will be an unfunded mandate to counties if they are to proceed with developing a paper-trail for elections. She indicated that this would be an expensive venture for the city to acquire the equipment necessary to comply with this mandate. Rep. Madden indicated that the City of Denver is neutral on this bill, and that it is the election commission who opposes the bill. Ms. Hatchett did not agree with the Rep. Madden's assessment.

03:21 PM -- Deena Larson, representing Coloradoans for Voting Integrity (CFVI), disabled, testified in support of the bill. She provided two handouts, Attachment B - Accessibility and Audibility in Electronic Voting, and Attachment C - a white paper with the same title as Attachment B.

03:27 PM -- Bob McGrath, representing CFVI, testified in support of the bill. He provided Attachment D, his written testimony to the committee on Senate Bill 05-198. Rep. Weissmann requested that the witness highlight his written testimony.

03:42 PM -- Dr. Charles Corry, Equal Justice Foundation, testified in support of the bill. He provided Attachment F, his curriculum vitae, and Attachment G, Electronic Voting Equipment Problems Tabulated by State and County. He stated that current voting machines are poorly designed and their software is not appropriate for the task. He responded to committee questions.

He stated that his organization believes this is a fairly weak bill, but it is a beginning. He responded to committee questions.

Representative Solano, prime sponsor, explained House Bill 05-1336 which establishes a legislative oversight committee to evaluate the quality of care provided in certain state and veterans nursing homes. Addresses the makeup of the committee and appointment of committee members. She responded to committee questions.

05:30 PM -- Marvin Meyers, representing the United Veterans Committee of Colorado, testified in support of the bill. He discussed issues and concerns regarding the quality of care in state and veterans nursing homes. The State Board of Veterans Affairs has expressed support for the bill.

Mr. Meyers responded to questions about the performance audit that had been completed on the veterans nursing homes. Representative Coleman asked whether the recommendations of the audit report could be incorporated into the legislative oversight committee's area of consideration.

05:35 PM -- George Thomas, representing the United Veterans Committee of Colorado, testified in support of the bill. Mr. Thomas responded to questions as to whether some veterans may be receiving care in private facilities.


05:36 PM -- Wayne Thompson, State Judge Advocate for the VFW, testified in support of the bill. He described some of the fiscal concerns and problems that state and veterans nursing homes are currently facing. He specified some of the provision of current contracts. He said that oversight of these nursing homes needs to continue and to follow up with legislative recommendations.

Mr. Thompson responded to questions about the whether the committee would address the affordability of new facilities for veterans. Representative Liston asked additional questions about the cost of quality care at a new facility. Committee members discussed the impact on Medicaid costs.

06:41 PM -- House Concurrent Resolution 05-1007

Representative Weissmann, Chair, indicated that Rep. Schultheis would be introducing and discussing his three measures simultaneously, House Concurrent Resolution 05-1007, HJR 05-1060, and HJR1062. Rep. Weissmann also indicated that witnesses providing testimony on these measures could discuss each of them when they provided testimony.

HJR 05-1060 pertains to the creation of an interim committee to study the impacts of illegal immigration on the State of Colorado. HJR 05-1062 is concerning urging support from the United States Government of enforcement of federal immigration laws. House Concurrent Resolution 05-1007 requires a state or county agency to provide services or public benefits only to citizens of the United States and person legally present in the United States. Before providing services, a state or county agency employee must require a person seeking services to provide documentation issued by the United States government or the State of Colorado. Specifically, the measure request that members of the Sixty-fifth General Assembly request that all members of the Colorado delegation to the U.S. House of Representatives and the U.S. Senate support actions to discourage the influx of illegal aliens into Colorado and other states and to reimburse the state for the current impact of illegal immigration on the state citizens and taxpayers. Rep. Schultheis indicated the strong movements of various groups in support of these measures. He responded to committee questions. Committee members commented on a television program which presented information on immigrants and false documentation use by some immigrants.

The meeting reconvened. Representative Schultheis responded to questions from committee members. Committee members discussed relevant federal legislation mentioned in the resolutions and the process of federal legislation.


07:23 PM

Representative Coleman stated that there should be business sanctions to discourage businesses role in cheap labor which is creating a market for illegal immigrants, and the smuggling of those immigrants into the United States. Rep. Schultheis believes the federal government has looked the other way when it comes to hiring illegal immigrants. He explained that federal law can address these issues, but it is not being enforced.



The following people testified:

07:26 PM -- Lisa Duran, representing Rights for All People, testified in opposition of the bill. She expressed some specific concerns about the measures. She believes that there are some troubling and erroneous presumptions on each of these measures and the issues that have been discussed during the meeting. She indicated that she has studies that conflict with what is being proposed in these measures. For instance, she stated that CEOs are making many more times the amount of front line workers, currently, than they have historically. She provided further examples that contest the intent of HCR 05-1007, HJR 05-1060, and HJR 05-1062.

07:34 PM -- Gabriel Flora, representing American Friends Service Committee, a Quaker organization, testified in opposition to the measures. She discussed the background of related federal legislation. Ms. Flora believes that the United States needs comprehensive immigration reform. She indicated that the North American Free Trade Agreement has displaced many Mexican workers, creating and influx of illegal immigrants. She responded to committee questions.

07:45 PM -- John Brick, representing citizen of Colorado, testified in support of HCR 05-1007. He explained that illegal immigration undermines the Colorado workforce, and the federal government has not been helpful with the illegal immigration issue. He requested that the committee put American workers first.

07:48 PM -- William Herron, representing Defend Colorado Now, testified in support of these measures and spoke in favor of the general trend of what Rep. Schultheis is trying to accomplish. He provided Attachment T, a graph entitled America's Failed Post - 1965 Immigration Policy.

07:59 PM -- Frosty Wooldridge, Citizens of Colorado, testified in support of the bill. He provided background information on his travels and the issue of illegal immigration. He provided background information on the number of illegal immigrants coming to America. He provided Attachment U, Hospital to the World Welcomes Illegals & Contagious Diseases. He asserts that with the influx of third world immigrants, who are unscreened, there has been a rise in various diseases, including tuberculosis, leprosy, and others. He believes that this isn't an issue of race.

08:15 PM -- Robert Copley, Sr., representing himself, testified in support of these measures. He discussed the Minuteman Project, a volunteer organization which patrols the Arizona border as a blocking force against entry into the U.S. by illegal aliens. He recounted his personal experiences at part of the Minuteman Project. He believes that government is irresponsible when it comes to immigration.


08:33 PM -- Leon Odendahl, representing himself, testified in support of all three measures. He explained that the U.S. can only assimilate so many immigrants.

Representative Weissmann, prime sponsor, introduced Senate Bill 05-213, which would repeal the requirement for periodic reports by each judicial district participating in the drug court demonstration to the House and Senate Judiciary Committees. It also would repeal other periodic reports to other House and Senate Committees. He explained the number of reports that are currently required. He responded to committee questions.
