Representative Riesberg, sponsor, presented the bill continuing the regulation of respiratory therapists. Amendments L.003 and L.004 were distributed to members (Attachments J and K).

Melinda Lemons, Colorado Society for Respiratory Care, discussed the need to regulate respiratory therapists, the bill's impact on patients, and testing of respiratory therapists.

Brian Tobias, Department of Regulatory Agencies, spoke in opposition to the bill and discussed the 2000 and 2004 sunset reports and indirect oversight of respiratory therapists. He stated earlier concerns regarding potential for harm to patients have not materialized. He answered questions about drug abuse, falsification of records, license renewal, and national testing of respiratory therapists.

Kevin Heupel, Department of Regulatory Agencies, spoke in opposition to the bill. He discussed national accrediting of respiratory therapy programs, costs associated with the regulation of respiratory therapists, drug abuse, falsification of records, fees charged to respiratory therapists, oversight of respiratory therapists, and patient complaints.

Janet Fox Stephens, Colorado Health and Hospital Association, spoke in opposition to the bill. She stated, however, that the association favors the continued regulation of respiratory therapists.
