01:37 PM -- Confirmation of Members to the Board of Stock Inspection Commissioners

Nominee Lee L. Spann said that he and the other nominees were all in favor of the reorganization of the board that occurred last year. Senator Isgar said he thought the board does a good job of protecting livestock in the state.

Senator Tochtrop asked each nominee introduce to himself. Nominee James Heird described the structure of the board concerning representation from the confinement, nonconfinement, and commodity other than confinement or nonconfinement, cattles industries.

Senator Taylor asked the nominees if they thought there were any bad components to the board's reorganization. Mr. Span responded that the board thought it would receive more spending authority for the purchase of items with industry rather than state money, such as pickup trucks. Senator Isgar said that he and other committee members would be interested in pursuing or discussing any recommended changes to the board with Don Ament, Commissioner of Agriculture.

Mr. Spann spoke about the sunset of certain fees pertaining to the cattle industry. Senator Taylor noted that issue could be examined in more detail when the fees come up for renewal next year. Senator Isgar said he thought there should be a fair and consistent methodology to the application of the fees.

01:53 PM -- House Bill 05-1070

Senator Grossman gave an overview of the bill concerning water conservation measures, describing each of the sections of the bill in detail.

Senator Isgar asked about Senator Hagedorn's bill, SB 05-100, which deals with covenants of homeowners associations, and how it relates to this matter. Senator Grossman responded.

Senator Entz spoke about amendments L.008 (Attachment A) and L.010 (Attachment B) that he was planning to offer. He also commented on Section 3 of the bill, and said that he thought the clarification this section provides is good.

Senator Taylor asked why there is no safety clause in the bill. Senator Grossman said that it was the preference of the bill's prime sponsor, Representative Weissman, but that he was willing to support a safety clause if that was the committee's preference.

Corky Kyle, Rocky Mountain Car Wash Association, testified in favor of the bill.

02:05 PM -- Elizabeth Gardener, Denver Water, testified in favor of the bill. She offered a suggestion for the bill that winter tree watering be allowed 24 hours a day during winter months, rather than being limited to certain times, and distributed a handout on tree care in dry climates (Attachment C).

Craig Coronato, Colorado Council of Landscape Architects, testified in favor of the bill.

Senator Grossman said that section 2, lines 5 and 6 are meant to apply only to state facilities, not all government or public facilities in the state. Senator Hillman said that should probably be clarified during second reading of the bill, which Senator Grossman said he did not have a problem doing.

Senator Grossman moved to refer the bill to the Committee of the Whole; however, no vote on this occurred, due to the bill being laid over, as amended, until Wednesday, March 9, 2005 (see 02:30 PM notation).
