Representative Garcia, Chairman, called the meeting to order and discussed the differences between the reengrossed and rerevised versions of House Bill 05-1001. Representative Garcia explained that the senate version requires a two-thirds majority vote to allow for transfers of cash funds whereas the house version prohibits cash fund transfers to the General Fund.

Senator Hagedorn commented that the General Assembly has had a history of requiring a two-thirds majority vote for measures that address spending limits. As an example, Senator Hagedorn cited the initial legislation that established the 6 percent spending limit. A two-thirds majority vote was required to exceed the 6 percent limit when the legislation was passed.

Representative Garcia moved to adopt conference committee report CLHB1001.001 (Attachment A) and explained that it would require that any cash fund transfers made by the General Assembly be designated as TABOR reserve funds. The motion passed on a 5-0-1 vote.
