Representative Benefield made opening remarks regarding HB05-1346. The bill allows health care providers to lower prices charged to health plans or to consumers in order to meet competition. The committee first heard witness testimony for this bill on Friday April 29.

Bill Imig, representing the Property Casualty Insurers Association, testified for the need to amend the bill. Mr. Imig testified that language the bill strikes on page 3, lines 12 and 13 regarding the applicability to no-fault auto insurance is still needed because no-fault claims may be made for up to ten years after no-fault was repealed in favor of the tort system.

Debbie Willi-Powell and Mike Feeley, representing Exempla Healthcare, testified in support of the bill and continued their testimony from April 29.

02:50 PM -- Representative Morgan Carroll offered amendment L.003 (Attachment A). She told the committee that the amendment removes the criminal consequence for reducing or waiving copays and deductibles.

Representative Knoedler made a substitute motion to Representative Carroll's motion by offering amendment L.002 (Attachment B). Representative Knoedler proposed to further amend L.003 on line 5 after the word "level" by inserting "or to increase an insurers cost sharing obligation above the in-network level." Representative Knoedler withdrew the amendment.

Representative Balmer made a substitute motion to Representative Carroll's motion by offering amendment L.005 (Attachment C). The motion was withdrawn.
