11:50 AM -- House Bill 05-1350 - Concerning the General Fund Exempt Account

Representative Romanoff, prime sponsor, explained the provisions of House Bill 05-1350. Representative Romanoff explained that should House Bill 05-1194 be approved by voters in the November 2005, General Election, House Bill 05-1350 would specify how moneys from House Bill 05-1194 would be appropriated or spent for specific purposes enumerated in House Bill 05-1350. The committee briefly discussed the spending purposes in House Bill 05-1350. Representative Romanoff distributed amendment L.002 (Attachment A) to committee members and explained the amendment as a technical change that would clarify language pertaining to institutions of higher education.

12:05 PM -- Senate Bill 05-222 - Concerning Gasoline and Special Fuel Taxes


Representative Larson, prime sponsor, explained the provisions of the bill. Representative Larson commented that Senate Bill 05-222 requires both special fuel and gasoline to be taxed by the gallon and provides each type of fuel the same allowances for losses in transit and costs of collection. The bill also requires fuel taxes to be remitted electronically, one day later than required by current law.

Representative Plant, prime sponsor, distributed a packet of materials on the legislation (Attachment C) and explained the provisions of the bill. The committee engaged in a discussion on fire safety issues as they apply to the bill.

Ms. JoAnn Groff, Colorado Retail Council, testified in opposition toward the measure. Ms. Groff commented that there may be concerns that some company-brands of cigarettes may not be able to obtain the fireproof paper as easily as other company brands.

Mr. Wilson Croom, Colorado Association of Distributors, testified in opposition toward the bill. The committee briefly discussed the ability of cigarette manufacturers to use the fireproof paper while remaining competitive.

Mr. Stan Dempsey, Colorado Petroleum Association, testified in opposition toward the bill and commented on the potential of a black market for cigarettes to emerge in the state.

01:10 PM -- House Bill 05-1333 - Concerning the Critical Needs Financing Corporation


(This bill was referred back to the House Finance Committee during the third-reading House debate on April 29 to allow the committee to discuss the need for a rainy-day fund for purposes of meeting state bond obligations during a future economic downturn.)














Representative Buescher, prime sponsor, explained the provisions of the bill and commented that a rainy day fund was not needed for purposes of meeting state bond obligations during a future economic downturn. Representative Buescher asked that testimony be heard from the Office of State Planning and Budgeting to address this issue.

Mr. Henry Sobanet, Director of the Office of State Planning and Budgeting, responded to committee questions and commented that if the state experiences an economic downturn in the future, for purposes of meeting bonding obligations under House Bill 05-1333, the state could use HUTF funds or moneys from securitizing tobacco moneys in place of a rainy day fund.

Mr. J.J. Ament, City Group Global Markets, responded to committee questions and questioned whether an additional reserve fund (rainy day fund) is needed for the state to ensure against any future economic downturn for purposes of paying future bond obligations.
