Representative Judd presented the bill which specifies that a person who has a duty to pay wages on behalf of an insolvent employer, and does not, is liable to the employee for unpaid wages. Representative Judd responded to questions from the committee.

Evan Lipstein, representing himself as an attorney who represents workers in Colorado, testified in favor of the bill. Mr. Lipstein testified regarding a case where an employer owed its employees unpaid wages, but under current law, the employer was not found liable. He also testified that there are twelve other states that have passed similar legislation. Mr. Lipstein responded to questions from the committee.

Heidi Heltzel, representing the Colorado Association of Commerce and Industry, testified in opposition to the bill. Ms. Heltzel testified that the bill would serve as a disincentive for entrepreneurs to start a new business in Colorado.
