The meeting was called to order by the chair, Senator Windels.

Senator Windels reviewed the provisions of a proposed conference committee report she would offer (.001, Attachment A). The report would amend the rerevised bill in two primary ways, by striking a section that reduces the State Education Fund appropriation for charter school capital construction from $5 million to $2.5 million; and by striking the appropriations to meet settlement obligations under the Giardino lawsuit which were contingent upon the failure of an anticipated ballot question. She noted that the Governor's Office had indicated to her that the Governor was not comfortable with the contingency provisions.

Senator Windels said that concerns had been raised about two FTEs that would be unfunded if the provisions for the school construction and renovation fund and the school capital construction expenditures reserve fund were struck from the bill. Representative King asked questions about funding that could be available from Powerball "spillover" moneys.

Christy Chase, Office of Legislative Legal Services, responded to questions about the allocation of Powerball spillover funds to the capital construction expenditures reserve. Carolyn Kampman, Joint Budget Committee staff, responded to additional questions and indicated that the Colorado Department of Education would have no spending authority to fund personal services items from the contingency reserve.

The committee continued to discuss the capital construction expenditures reserve. Rachel Nance, Office of the Governor, came to the table to respond to questions about the Governor's position on funding for Giardino settlement obligations. She said that the funding obligation will be there due to existing triggers in law, that will be triggered for FY 2005-06. Senator Spence discussed the several mechanisms that exist for school district capital construction. Ms. Chase discussed the potential for an amendment restoring the requirement that the school capital construction expenditures reserve receive the same amount of funding from the State Education Fund as charter schools receive for capital construction.
