Senator Teck joined the committee via telephone and explained bill A - Concerning the Procurement of Information Technology Systems (Attachment A). A strike below amendment, proposed amendment #1, was distributed to the committee (Attachment D). He explained that the amendment requires that prior to the approval or disbursement of any moneys, whether from federal or cash funds, for any major automation system development project, the Office of Innovation and Technology within the Office of the Governor must certify that the project is in compliance with best practices of the state. Best practices are defined to include assigning project managers and project manager analysts to manage the state's resources and responsibilities for the project. The amendment further requires the Department of Personnel and Administration to create a job category within the state personnel system for individuals employed as project managers and project management analysts. Further, the amendment requires that the Office of Innovation and Technology annually submit a report to the Joint Budget Committee and the House and Senate Business Affairs and Labor Committees describing the use of project managers and project management analysts and any significant automation system development projects currently in progress.

Representative Weissmann discussed proposed amendment #1 (Attachment D). He suggested that the amendment be amended to change the requirement that the report go to the committee of reference with oversight over the technology project, rather than to the Business Affairs and Labor Committees. Senator Owen asked if the Office of State Budgeting and Planning already prioritizes technology projects. Senator Teck responded that the legislature should create a mechanism to make sure that technology projects are well planned and have proper oversight. Mr. Felice asked how the project manager would be evaluated. Mr. Houlihan questioned how the bill's authorization permitting departments and agencies to hire a contract employee as a project manager fits with other state contracting policies.

Bob Lackner, Office of Legislative Legal Services, came to the table to respond to Mr. Felice's questions. He stated that it was not the intent of the provision to circumvent existing laws regarding contracting. He offered to further define the provision to ensure it doesn't conflict with existing laws.

Note: Pursuant to Joint Rule 24A (g), legislators are not permitted to vote in any interim study committee via telephone or other electronic connection. Therefore, Senator Teck was not permitted to vote on the amendments to, or final action on, Bill A.
