Representative Marshall presented SB05-013 which requires individuals applying for renewal of real estate broker or salesperson licenses to first submit fingerprints and a fee to the Colorado Bureau of Investigation for a background check. This requirement is effective for three years to assure that background checks are completed for each broker or salesperson. Renewed licenses are effective for three years so each applicant is required to have one check. Persons maintaining an inactive license are not required to submit fingerprints for a background check.

Carol Richmond, representing the Colorado Association of Realtors, testified in favor of the bill. Ms. Richmond testified that there is a loophole in the current system that makes fingerprints recorded prior to three years ago unavailable.
