Representative Windholz, prime sponsor, asked the committee to postpone indefinitely House Bill 15-1190 because the provisions of the bill have been amended into House Bill 15-1170. The bill requires that the State Work Force Development Council in the Colorado Department of Labor and Employment (CDLE) collaborate with the Colorado Department of Education (CDE) in order to:

Representative McCann, sponsor, presented Senate Bill 15-047. Under current law, the Office of Legislative Legal Services (OLLS) provides written notice to members of the General Assembly when administrative rules adopted by state agencies are the result of legislation for which the member was a prime sponsor or co-sponsor. This bill, recommended by the Committee on Legal Services (COLS), permits the OLLS to develop a system for members of the General Assembly to voluntarily opt out of this rules notice procedure for bills for which they were co-sponsors. Representative McCann provided an example of two relevant notifications (Attachment A). She responded to questions from the committee about the process for opting out of the notifications.

Representative Carver, prime sponsor, presented House Bill 15-1095. The bill allows a common interest community (commonly referred to as a homeowners' association, or HOA) created before the 1992 enactment of the Colorado Common Interest Ownership Act (CCIOA) to be exempt from certain provisions of CCIOA if the HOA's annual assessments do not exceed a statutory threshold of $300. To qualify for the new exemption, the $300 limit must be established in the HOA's recorded declaration or bylaws. Representative Carver distributed and explained amendment L.002 (Attachment B). She responded to questions from the committee about the safety clause on the bill.

Dave Munger, representing the Council of Neighbors and Organizations, testified in support of the bill. Mr. Munger spoke about the types of HOAs that will be affected by the bill.

William Schmidt, representing the Comstock Village HOA, testified in support of the bill. Mr. Schmidt explained that his HOA is limited in how much it can charge each of its members.

Gary Kujawski, representing the Department of Regulatory Agencies, came to the table to answer questions about the bill. Mr. Kujawski explained why some small HOAs are not included in the existing exemption.

The committee reconvened. Representatives Tate and Tyler, co-sponsors, presented House Bill 15-1213. They distributed a fact sheet about the bill (Attachment C). This bill, recommended by the Joint Technology Committee, makes changes related to the Governor's Office of Information Technology (OIT). Specifically, it defines an enterprise agreement as any agreement for the purchase of information technology (IT), including IT goods and services, that OIT enters into for the benefit of the state and that is created in furtherance of the office's requirements or responsibilities. The definition of an enterprise facility is changed to include any facility, including state offices, state warehouses, state leased spaces, and vendor facilities that OIT designates as a facility where state data, equipment, and IT, including IT goods, will be located or where services will be provided.

The bill also changes the responsibilities of OIT to include the procurement of enterprise facilities and the use of enterprise agreements. Finally, the bill eliminates provisions of current law that exempt OIT from using the state's procurement code in emergencies and require OIT to promulgate rules for emergency procedures.

Steven Sizemore, representing OIT, came to the table to address a question from the committee about a part of the bill referencing the State Procurement Code. He also discussed how emergency spending is authorized by the department.
